Terms of Use

These Terms of Use ("Terms") govern your use of nftenergydrinks.com (the "Site") and purchases made through it. By using the Site you agree to these Terms. If you don't agree, please don't use the Site.

1. The products

NFT Energy beverages contain caffeine. Check your can’s label for serving size, caffeine content and ingredients. They are not recommended for children, people sensitive to caffeine, or women who are pregnant or nursing. Consume responsibly. Product statements on this Site have not been evaluated by the Food and Drug Administration; our products are not intended to diagnose, treat, cure, or prevent any disease.

2. Orders, pricing & payment

All prices are in U.S. dollars and may change without notice. We accept major cards and select cryptocurrencies (e.g., SOL and USDC on Solana). Crypto payment amounts are calculated at the time of checkout; blockchain transactions are final once confirmed, subject to our Refund Policy. We may refuse or cancel any order, including for suspected fraud or pricing errors.

3. Digital collectibles & holder benefits

• The Energy Wabbits are digital collectibles on the Solana blockchain, sold and traded on third-party platforms (e.g., GraveMint) under those platforms' own terms. We do not custody your wallet or your collectibles.
• Wabbits are offered for collectible and community use. We do not promise investment returns, appreciation, liquidity, or resale opportunities. A label does not determine a digital asset’s legal treatment. Holders are community members; holding a Wabbit does not make anyone an owner, shareholder, or investor in NFT Energy LLC.
• Holder benefits depend on the specific program, availability, verified holdings, and its published terms. $WABBIT is live on Solana. The official contract address is 3ropwqf75V8qbtRHBdQMQjnFSeDYtFmRkWUpKtdeXQ3V. Token launch does not automatically activate payments, prize rounds or locked staking; each feature shows its current availability in the Wabbit Hole. Planned uses include Wabbit merchandise, Wabbit Spin, Wabbit Scratcher and other ecosystem features. Acceptance for NFT Energy drink purchases is a separate planned payment use. A launchpad link is not an active token offering or a financial entitlement. Holding or staking a Wabbit does not by itself earn income, commissions, tokens, or a share of company revenue.
• A can label, shared QR code, or purchase does not by itself create a right to a random prize. See our Rewards & Promotions Policy and the official rules of any specifically announced campaign. No public native-token redemption campaign is currently open.
• Use a compatible wallet on the stated network and protect your sign-in credentials. Fees, if any, are disclosed before a transaction; no purchase or claim payment is required for a free promotional entry. You remain responsible for any taxes required by law. Test assets have no monetary value or entitlement to future tokens.

4. Community programs

Ambassador, wholesale, and partnership programs are subject to acceptance and their own program terms. The Wabbit Hole is open to the public. Wabbit Run publishes verified community scores; a score is not a prize award. We may reject manipulated submissions or investigate abuse, with support available to review errors. Wabbit Spin and Wabbit Scratcher offer free practice with example results and no payouts. Real-prize entries are not open. Reward inventory alone does not open a promotion.

Community votes

Community votes are advisory and do not confer corporate voting rights. Each question states who can vote and its opening and closing times. Ownership is verified when a vote is submitted. Diamond Ear questions require at least 10 verified Energy Wabbits in the connected collection wallet. Each eligible member gets one final vote per question, regardless of the number of wallets linked. Owners can follow running totals; aggregate results become public after the deadline. Cancelled questions stop accepting votes and are marked cancelled.

Accounts, wallets & staking

The Wabbit Hole uses Privy for email and compatible wallet sign-in. New members may create an optional email-connected wallet or link an existing wallet. Link additional sign-in methods while signed in to your existing profile; signing in separately with an unlinked wallet can create another account. Profile names, selected owned-Wabbit pictures and qualifying leaderboard activity are public. Email addresses, wallet addresses and private ambassador dashboard links are not published in the profile. We do not store customer private keys or seed phrases in our store database. Privy and external wallet providers have their own terms and privacy notices.

Current Wabbit staking is a verification-based registration: your NFT remains in your wallet, and eligibility depends on continued verified ownership. It is not a deposit, guaranteed yield, or token reward. Sale or transfer of an NFT can affect benefits after ownership is checked. Blockchain transactions may be irreversible; wallet confirmation and the transaction receipt identify the actual network and asset.

Sales progress & ambassador reporting

Approved ambassadors are matched using their verified ambassador email. Their private dashboard access remains separate from public profile information. The Wabbit Hole’s energy-drink sales tracker excludes merchandise and adjusts qualifying sales for refunds or review. A sales milestone does not itself authorize a payment. Ambassador commissions follow the accepted ambassador agreement and verified order records. Community reporting and the ambassador portal use the same commission source; display updates may lag while payment events are processed. Simulated pilot orders are separate from live sales and commissions.

Private tests & promotion rules

Private tests may simulate payments, delivery, prizes, and gas-sponsored transfers. They do not constitute a live offer of the forthcoming Wabbit ecosystem token or a public sweepstakes. For any future public chance-based promotion, no purchase is necessary, and a purchase will not improve the chances of winning. The specific official rules must identify the free entry route, eligibility, dates, quantities, selection method, odds, and fulfillment before entry opens. This policy alone does not open a promotion.

5. Intellectual property

The Site, the NFT Energy and Energy Wabbits names, logos, can designs, characters, and content are owned by NFT Energy LLC or its licensors. You may not use them commercially without written permission. Partner community art featured on cans remains the property of its respective owners and is used under license.

6. Acceptable use

Don't misuse the Site: no unlawful activity, no scraping at scale, no attempting to breach security, no impersonating the brand or its founders, and no using the Site to infringe others' rights.

7. Disclaimers & limitation of liability

The Site is provided "as is" without warranties of any kind. To the fullest extent permitted by law, NFT Energy LLC is not liable for indirect, incidental, special, or consequential damages arising from use of the Site or products, and our total liability for any claim is limited to the amount you paid us for the product giving rise to the claim.

8. Governing law & disputes

These Terms are governed by the laws of the State of Georgia, USA, without regard to conflict-of-law rules. Disputes will be resolved in the state or federal courts located in Georgia, unless applicable law requires otherwise.

9. Changes

We may update these Terms prospectively and post the effective date. Material changes will be identified on the site or otherwise communicated as required by law. A later site-policy update does not retroactively replace the official rules accepted for an existing promotion or remove mandatory consumer rights.
