Terms of Use

These Terms of Use ("Terms") govern your use of nftenergydrinks.com (the "Site") and purchases made through it. By using the Site you agree to these Terms. If you don't agree, please don't use the Site.

1. The products

NFT Energy beverages contain caffeine (210 mg per 16 fl oz can). They are not recommended for children, people sensitive to caffeine, or women who are pregnant or nursing. Consume responsibly. Product statements on this Site have not been evaluated by the Food and Drug Administration; our products are not intended to diagnose, treat, cure, or prevent any disease.

2. Orders, pricing & payment

All prices are in U.S. dollars and may change without notice. We accept major cards and select cryptocurrencies (e.g., SOL and USDC on Solana). Crypto payment amounts are calculated at the time of checkout; blockchain transactions are final once confirmed, subject to our Refund Policy. We may refuse or cancel any order, including for suspected fraud or pricing errors.

3. Digital collectibles & holder benefits

• The Energy Wabbits are digital collectibles on the Solana blockchain, sold and traded on third-party platforms (e.g., GraveMint) under those platforms' own terms. We do not custody your wallet or your collectibles.
• Wabbits are collectibles and community memberships, not investments, securities, or equity. Holders are holders and community members; holding a Wabbit does not make anyone an owner, shareholder, or investor in NFT Energy LLC.
• Holder benefits (voting, token-gated merch, event access, member pricing, staking, rewards, and revenue-share eligibility for Diamond Ear holders) describe eligibility under the programs as offered from time to time. They are not promises of profit, income, or guaranteed returns, and programs may be modified to comply with law.
• Scanning a can earns rewards for drinking as described at the time of the promotion; specific rewards are not guaranteed.
• You are responsible for your own wallet security, transaction fees, and taxes.

4. Community programs

Ambassador, wholesale, and partnership programs are subject to acceptance and their own program terms. Community events, votes, quests, and rewards in the Wabbit Hole are operated in partnership with third-party platforms and may change or end.

5. Intellectual property

The Site, the NFT Energy and Energy Wabbits names, logos, can designs, characters, and content are owned by NFT Energy LLC or its licensors. You may not use them commercially without written permission. Partner community art featured on cans remains the property of its respective owners and is used under license.

6. Acceptable use

Don't misuse the Site: no unlawful activity, no scraping at scale, no attempting to breach security, no impersonating the brand or its founders, and no using the Site to infringe others' rights.

7. Disclaimers & limitation of liability

The Site is provided "as is" without warranties of any kind. To the fullest extent permitted by law, NFT Energy LLC is not liable for indirect, incidental, special, or consequential damages arising from use of the Site or products, and our total liability for any claim is limited to the amount you paid us for the product giving rise to the claim.

8. Governing law & disputes

These Terms are governed by the laws of the State of Georgia, USA, without regard to conflict-of-law rules. Disputes will be resolved in the state or federal courts located in Georgia, unless applicable law requires otherwise.

9. Changes

We may update these Terms; the version posted here with the latest effective date applies. Continued use after changes means acceptance.
